Council Attacks to Pay, Terms & Conditions - Update 5

branch-squareThe trade unions were asked to attend a meeting today with the Chief Executive, Ian Curryer, and Councillor Nicola Heaton, Portfolio holder for Human Resources. They advised the unions that the proposals previously tabled for discussion with the trade unions and which were going to be presented in a total package for the trade unions to consider and provide a formal response, were being withdrawn as a result of the outcome of the Employment Appeal Tribunal. They stated they were going to review what had already been discussed with us and will arrange to meet again with the trade unions in five to six weeks.

Update on Employment Appeal Tribunal Decision on Annual Increments

branch-squareUNISON's solicitors are writing to UNISON members involved in the above claim to communicate the decision of the Employment Appeal Tribunal (EAT) which gave its outcome last week.

The EAT decided in favour of about 90% of the Claimants in that they did have a contractual right to incremental progression despite the employer introducing a pay freeze in 2011. This is excellent news for the majority of our members and further information will be detailed in our solicitor's letter to those concerned. The EAT decision unfortunately also ruled that about 10% of the claimants were not entitled to the increments which is disappointing.

We are led to believe that the City Council will most likely be appealing this decision and UNISON are currently considering whether we also wish to appeal the decision on the 10% of claims which were unsuccessful.

UNISON LGPS Parliamentary Petition

We have established an LGPS Parliamentary petition which requires 100,000 signatures to get a debate in the House of Commons over changes to your pension funds.

Debate in the House the Local Government Pension Scheme Investment Regulations
5 million people rely on the LGPS to pay their pensions. Government wants powers over LGPS investment funds, but they could gamble away members' money on infrastructure projects. This is not allowed in any other UK scheme, including the MPs'. The LGPS must be invested in members' best interests.

Parliament must debate this issue and make the government accountable for these powers of intervention as any such direction may breach the law. Specifically Article 18 paragraph 3 of the EU Directive 41/2003 Institutions for Occupational Retire Provision: "Member States shall not require institutions located in their territory to invest in particular categories of assets."
